1. Right to export
- Full export is a core feature of every Plan and can be performed during the active Agreement and in the period after it ends.
- The export includes structured Community data in a documented, machine-readable format and files in their original formats, with a scope and integrity manifest. Available operational reports may additionally be generated as CSV/XLSX/DOCX/PDF, depending on the feature.
- Standard self-service export carries no exit fee. Non-standard work, mapping to the destination system or project assistance requires a prior quotation.
2. Provider switching request
- The Customer's authorised administrator initiates the export and specifies the requested termination date.
- Brillnet confirms the scope, dependencies, recipient's identity and secure transfer method.
- The parties agree on a reasonable transition plan, continuity and the cut-off point for writes. Brillnet does not transfer data to a new provider without an unambiguous instruction and verification.
- The export token is short-lived, single-use or restricted, and downloads are logged.
3. Period after termination
- After the Agreement ends: 90 days of read-only access and export.
- No new business operations are accepted during this period, but the Customer may verify data and repeat exports.
- Production data may be deleted earlier on the Customer's written instruction, provided that no legal preservation obligation applies.
4. Deletion
After the read-only period, Brillnet deletes production data, indexes, attachments and derived data. Backups expire within 90 days and remain isolated. Brillnet provides confirmation on request.
5. Data Act requirements
Brillnet designs the switching process in accordance with Regulation (EU) 2023/2854, which covers, among other matters, data processing services. Pre-contractual information, open interfaces/formats, switching assistance, continuity and deletion are covered by this policy. From 12 January 2027, Brillnet will not charge switching fees to the extent prohibited by the Data Act. Mandatory legal provisions take precedence.
6. Customer responsibilities
The Customer should verify the completeness of the export and the destination import before the period expires. The Customer is responsible for its agreement with the new provider, a secure downloading device and retaining its own copies after transfer.
Scope of backup periods
D1/R2 windows concern application infrastructure. They are not universal retention statements for every email-provider or other recipient copy. Sending data, own billing and security require separate role, purpose, retention and basis mapping. Deletion requests are assessed accordingly; a supplier term alone does not replace a legal basis or customer instruction.
Switching providers — Data Act
For a data processing service covered by Regulation (EU) 2023/2854, we apply switching and export rights. From 12 January 2027, we do not charge switching fees prohibited by Article 29. Separately commissioned work may be charged only where lawful; it cannot circumvent free switching or restrict required assistance. The relevant service terms set out export scope and timing.
Requests to switch provider, port to on-premises infrastructure or erase without switching may be sent to the service contact. For a service within the Data Act, notice does not exceed two months and the standard transitional period does not exceed 30 calendar days. We provide required assistance, security and continuity of contracted functions. If 30 days is technically unfeasible, within 14 working days of the request we give reasons and an alternative period of at most seven months. The customer may extend the transition once. Data remain retrievable for at least 30 days after it ends. Export exclusions cannot impede or delay switching. A preservation hold alone does not bar export; restrictions require a specific basis and scope. Contract termination and deletion are coordinated with this procedure and the customer’s instructions.
The agreement for the service subject to switching ends when switching succeeds, or after the notice period for erasure without switching. This procedure takes precedence over a conflicting general end-of-paid-period term. The 90-day window does not shorten the right to retrieve data for at least 30 days after transition. Export includes customer structured data, settings, documents and attachments. Proprietary code, secrets, internal safeguards and other customers’ data are excluded only without impeding portability. Extra work is quoted only beyond required assistance and where lawful.
